As of June 9, 2010, only one bill (HB 1143- Dealing with Health Care) is still to be acted on in some manner. All other enrollled bills from the 2010 Session have been dealt with in one way or another. SB 1752 (Economic Development) was signed by the Governor on May 28th. This bill, among a number of other things, revises provisions related to DEP delegation of permits, reauthorizes the exemptions granted under SB 360 last year, and includes certain permit extensions. HB 7129 (Relating to Military Support) was signed by the Governor on June 1st. This bill contains provisions that deal with compatibitlity of land development with military installations in local comprehensive plans. HB 143 (Relating to Exemption for Aircraft Assembly and Manufacturing Hangars from Comprehensive Plan Transportation Concurrency Requirements) was signed by the Governor on May 7th. HB 7103 (relating to Agriculture) was vetoed by the Governor on May 15th. HB 7103 would have prevented counties from regulating agriculture if the agricultural activity already is regulated by the state. And it required developers to acknowledge they are building next to agricultural lands in an attempt to keep new homeowners from trying to shut it down. This was also the bill that amended existing language to state that nonresidential farm buildings and fences are exempt from the Florida Building Code and all local codes or fees except for floodplain management regulations. Crist in his veto message on that bill said that there was not "adequate justification for the state to interject its authority over local decision making." He said that bill applies a "remedy" without identifying a problem.
None of the bills that would have reauthorized DCA and brought the sunset review process to a conclusion, passed the Legislature. However, it is important to note that DCA was not singled out. 2010 APA Florida Legislative Platform
APA Florida’s Legislative Program and Policies represent the Chapter’s positions on professional planning issues especially related to the State’s annual Legislative Session. Developed over time, most remain essentially the same and offer background and guidance as issues emerge or change on an annual basis. Similarly, the Chapter’s major priorities remain constant, unless significant legislative initiatives surface requiring reordering.
The Legislative Policy Committee acts upon a legislative platform that approved by the Executive Committee and presented to the membership for a vote at the APA Florida Annual Conference. The platform identifies the policy issues that APA Florida will work on, presents general positions on these issues, and establishes issue priorities. Any comments that you want to provide on these legislative issues will be welcome.
